1. Payment
Unless otherwise agreed in writing, payment terms are as follows:
50% upon order confirmation and 50% upon delivery, by bank transfer,
upon receipt of invoice.

Any specific payment terms (e.g. net 30 or net 60 end of month) must be agreed upon before the project starts.
In the absence of explicit agreement, the default terms apply.

2. Late Payment Penalties
In accordance with Belgian law (Article 5 of the Act of 2 August 2002 on combating late payment in commercial transactions), any late payment will result in the automatic application of interest without prior notice.

The default interest rate is based on the official reference rate published by the Belgian Ministry of Finance, increased by 8 percentage points.

A fixed compensation of €40 will also be charged to cover recovery costs, as stipulated by law.

3. Intellectual Property
Usage rights for the visuals produced are transferred to the client only after full payment of the service.

Source files (3D models, scenes, Photoshop layers, etc.) remain the property of SparkViz, unless otherwise agreed in writing.

4. Order Cancellation or Modification
Any cancellation or modification of an ongoing project must be notified in writing.
In case of cancellation, any payments already made shall remain acquired by SparkViz as compensation for work already performed.

5. Delivery
Delivery times are provided for information purposes only.
SparkViz will make every effort to meet deadlines, except in cases of force majeure or project changes during production.

6. Image Modification and Integrity
The visuals delivered by SparkViz may not be altered, edited, or modified in any way by the client or third parties without prior written consent.
This includes (but is not limited to) cropping, color adjustments, insertion of elements, or removal of elements from the images.

Any unauthorized modification may result in a loss of usage rights and may expose the client to legal liability.
SparkViz reserves the right to request the removal of any altered version from public or commercial use.

7. Use and Publication
The visuals provided by SparkViz are intended solely for the project and purpose defined at the time of the order.
If the client wishes to reuse the images for another project or context, a written request must be submitted.

SparkViz reserves the right to display selected visuals in its portfolio or communication materials, unless otherwise agreed in writing.
